The short version. This site gives you information about homes in the Coachella Valley and a way to get in touch. Nothing here is a promise about a specific property, a price, or a result, and filling out the form does not by itself make us your agent - that takes a signed written agreement. Verify anything that matters before you act on it.

1. Acceptance of These Terms

These Terms and Conditions ("Terms") govern your access to and use of yourdesertmove.com (the "Site"), operated by Desert Cities Home ("we," "us," or "our"). By accessing the Site, submitting a form, or otherwise using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Real estate brokerage services referenced on this Site are provided by Mike Haque, CA DRE# 01745484, a licensed California real estate salesperson affiliated with eXp Realty of California, Inc., CA DRE# 01878277.

Our Privacy Policy is incorporated into these Terms by reference and explains how we handle your personal information.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use this Site. By using the Site you represent that you meet these requirements and that the information you provide to us is accurate.

3. No Agency Relationship Is Created by Using This Site

This is the most important thing on this page.

Submitting a form, sending us a message, receiving listings from us, or speaking with us does not create an agency relationship, a fiduciary duty, or a brokerage relationship between you and Desert Cities Home or eXp Realty of California, Inc. Under California law, an agency relationship with a buyer or seller is established only through a signed written agreement, such as a Buyer Representation and Broker Compensation Agreement or a Residential Listing Agreement.

Until such an agreement is signed, we owe you honesty, fair dealing, and the disclosures required by law - but not the fiduciary duties owed to a client. If you are already represented by another broker under an exclusive agreement, please tell us, and we will respect that relationship.

4. Real Estate Information Is Not a Representation

Property information on this Site, including anything shown in videos, images, or descriptions, may come from multiple listing services, public records, sellers, or third-party sources. It is deemed reliable but is not guaranteed and may be inaccurate, incomplete, or out of date. Specifically:

• Properties shown may already be under contract, sold, withdrawn, or off market

• Prices, taxes, assessments, association dues, and terms change and may be listed incorrectly

• Square footage, lot size, room counts, year built, permit status, and zoning are from third-party sources and are frequently wrong

• Photographs and video may be edited, staged, virtually staged, or taken at a different time, and may not reflect current condition

• School district, boundary, flood zone, and utility information changes and must be independently confirmed

You are responsible for independently verifying any information that matters to your decision. Retain qualified professionals - inspectors, appraisers, contractors, surveyors, attorneys, and tax advisors — as appropriate.

5. Not Legal, Tax, Financial, or Investment Advice

Content on this Site is general information about real estate, not professional advice. We are not attorneys, accountants, tax advisors, lenders, appraisers, contractors, or licensed inspectors, and nothing on this Site should be treated as legal, tax, financial, investment, or engineering advice. Market commentary and any statements about values, appreciation, rents, or investment returns are opinions, not predictions or guarantees. Consult the appropriate licensed professional before acting.

6. Fair Housing

We support and comply with the federal Fair Housing Act, the California Fair Employment and Housing Act, and the Unruh Civil Rights Act. All properties referenced on this Site are offered without regard to race, color, religion, sex, gender identity, sexual orientation, familial status, national origin, disability, age, marital status, ancestry, source of income, veteran or military status, genetic information, or any other characteristic protected by law.

Consistent with fair housing law, we do not provide opinions or data regarding the racial, religious, ethnic, or other protected-class composition of any neighborhood, and we do not steer clients toward or away from areas on that basis. We are glad to refer you to objective public sources so you can research any community yourself.

7. Communications Consent

When you submit a form and check the consent box, you agree that Desert Cities Home may contact you by phone call, email, and SMS text message regarding real estate services, including through automated technology and, in some cases, artificial or prerecorded voices. Consent is not a condition of purchasing any goods or services.

8. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms

• Submit false, misleading, or another person's information without authorization

• Scrape, harvest, crawl, or use automated means to extract data or listing content from the Site

• Copy, reproduce, republish, or redistribute Site content for commercial purposes without our written permission

• Attempt to gain unauthorized access to the Site, its servers, or any connected system

• Introduce malware or interfere with the operation, security, or integrity of the Site

• Use the Site or any contact information obtained from it to send unsolicited commercial messages

• Frame, mirror, or misrepresent your affiliation with us

9. Intellectual Property

The Site and its content - including text, video, photography, graphics, layout, and the Desert Cities Home and Your Desert Move names and logos - are owned by us or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use in connection with your own real estate needs. All other rights are reserved.

Listing content and photographs may be owned by third parties, including listing brokers, photographers, and multiple listing services, and are used under license. Do not reuse them.

If you believe content on the Site infringes your copyright, contact us using the information in Section 15 with a description of the work, its location on the Site, your contact information, and a statement of good-faith belief that the use is unauthorized. We will investigate and respond appropriately.

10. Content You Submit

You are responsible for the information you submit through the Site. By submitting it, you represent that you have the right to do so and that it is accurate. You grant us a non-exclusive, royalty-free license to use that information as needed to respond to you and provide the Services, consistent with our Privacy Policy.

11. Artificial Intelligence

Some content on this Site and some communications you receive from us may be generated or assisted by artificial intelligence. AI-generated content may contain errors, omissions, or inaccuracies and should not be relied upon without independent verification. See Section 8 of our Privacy Policy for details and for your rights regarding our use of AI.

12. Third-Party Sites and Services

The Site may link to or embed third-party websites and services, including video platforms, mapping services, listing portals, and lender or vendor websites. We do not control them, we do not endorse them by linking, and we are not responsible for their content, products, services, or privacy practices. Your dealings with any third party are solely between you and that third party.

13. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION ON IT IS ACCURATE, COMPLETE, OR CURRENT.

14. Limitation of Liability and Indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, DESERT CITIES HOME, MIKE HAQUE, AND EXP REALTY OF CALIFORNIA, INC., AND THEIR RESPECTIVE AGENTS, EMPLOYEES, AND AFFILIATES, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).

Nothing in these Terms limits liability that cannot be limited under California law, including liability for fraud or for a real estate licensee's statutory duties.

You agree to indemnify and hold us harmless from any claims, damages, losses, and reasonable attorneys' fees arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to personal jurisdiction there.

This Section governs disputes about the Site and these Terms. Disputes arising under a separate signed agreement, such as a listing or buyer representation agreement, are governed by the dispute resolution provisions of that agreement, which typically require mediation and arbitration.

16. Changes, Severability, and Contact

We may modify these Terms at any time by posting a revised version with an updated "Last Updated" date. Material changes take effect when posted, and your continued use of the Site constitutes acceptance. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of it.
